Terms of Use

These Terms of Use govern your access to and use of the Phase Intelligence website, documentation, project pages, research tools, examples, demos, and related materials. By using them, you agree to these terms.
Operator
Phase Intelligence is an unincorporated research initiative operated by its founding team. References to "we," "us," and "our" in these Terms mean Phase Intelligence and the team operating it.
Research Initiative
Our materials and tools may describe or demonstrate early-stage research prototypes. They are provided for research, evaluation, education, and experimentation.
No Professional Advice
Our website, tools, outputs, examples, documentation, and research materials do not constitute engineering, scientific, legal, medical, safety, regulatory, financial, or professional advice. You are responsible for independently verifying any result before relying on it.
No Guarantee of Accuracy
AI-generated outputs and computational workflows may be incomplete, incorrect, unstable, non-reproducible, or unsuitable for your use case. Simulations, configurations, code, and interpretations should be reviewed by qualified humans and validated against appropriate theory, benchmarks, experiments, and safety requirements.
Open-Source Software
Some Phase Intelligence projects may be released as open-source software. Open-source repositories are governed by the license files and notices included with those repositories. If there is a conflict between these Terms and a repository's open-source license, the open-source license controls for that repository's licensed code.
Acceptable Use
You agree not to:
- use our services to violate laws, regulations, or third-party rights;
- attack, disrupt, overload, scrape, or reverse engineer hosted services;
- submit malware, harmful code, or intentionally misleading inputs;
- attempt to bypass access controls, rate limits, or security measures;
- use outputs without appropriate review in safety-critical contexts;
- misrepresent your affiliation with Phase Intelligence or our projects.
User Content
You are responsible for content you submit, including prompts, files, configurations, code, feedback, issues, pull requests, and messages. You must have the rights needed to submit that content. Do not submit confidential, regulated, export-controlled, or sensitive information unless we have a separate written agreement that permits it.
Feedback
If you send us feedback, suggestions, bug reports, or ideas, you grant us permission to use them to improve Phase Intelligence projects without obligation to compensate you. This does not transfer ownership of your underlying research data or private materials.
Ownership and Outputs
Phase Intelligence retains all rights in its websites, tools, models, source code, and documentation, except for components released under an open-source license, which are governed by those licenses. You retain any rights you already hold in the inputs you submit.
As between you and Phase Intelligence, and to the extent we hold any assignable rights in them, we do not claim ownership of the outputs generated for you from your inputs, and you may use those outputs subject to these Terms and applicable law. We make no representation that outputs are original, non-infringing, or eligible for intellectual property protection, and comparable outputs may be generated for other users.
Third-Party Materials
Our website, documentation, or tools may link to third-party services, repositories, models, datasets, papers, packages, or infrastructure. Those third-party materials are governed by their own terms, licenses, and policies.
Changes and Availability
We may change, suspend, or discontinue any website feature, project page, hosted tool, demo, documentation, or service at any time. We may also update these Terms as the initiative evolves.
If Phase Intelligence is later transferred to or operated by a newly formed legal entity, we may update these Terms to reflect that transition and, where appropriate, assign operation of the services and related rights and obligations to that entity.
Disclaimers
To the fullest extent permitted by law, Phase Intelligence materials and services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law, Phase Intelligence and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, research opportunity, or business interruption arising from your use of our website, tools, documentation, or outputs.
To the fullest extent permitted by law, the total aggregate liability of Phase Intelligence and the team operating it for all claims arising out of or relating to our website, tools, documentation, APIs, or outputs is limited to the greater of (a) the total amounts you paid to us, if any, for the relevant service in the twelve months before the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, for death or personal injury, or under mandatory consumer-protection or product-liability law. Because some jurisdictions do not allow certain limitations, parts of the above may not apply to you.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Phase Intelligence and the team operating it from third-party claims, damages, liabilities, and reasonable costs arising out of your misuse of our website, tools, or APIs, your violation of these Terms or applicable law, or content you submit that infringes the rights of others. This does not apply to the extent a claim results from our own intentional misconduct or gross negligence.
API Terms
If you use a Phase Intelligence hosted API, your use is also governed by our API Terms. If the API Terms conflict with these Terms, the API Terms control for API access and usage.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Governing Law
These Terms are intended to operate only to the extent permitted by applicable law, and nothing in them limits rights that cannot be lawfully limited or waived. Except where mandatory local law provides otherwise, these Terms are governed by the laws of Germany, without regard to conflict-of-laws rules.
If you use our services as a consumer, you keep the protection of the mandatory consumer provisions of the law of the country where you live, and nothing in these Terms overrides those protections.
